Donald Trump has become the first former president to be convicted of a crime, facing the prospect of imprisonment after being found guilty on 34 felony counts of falsifying business records.

Despite this legal setback, Trump remains the presumptive Republican nominee for a likely rematch with President Joe Biden in November. However, any potential jail time resulting from his conviction is expected to be delayed as he appeals the jury’s decision, a process that may extend beyond the upcoming election.

Regarding the possibility of incarceration, each felony count of falsifying business records carries a maximum sentence of four years, with New York law capping sentencing for such felonies at 20 years. While some legal experts suggest Trump may only receive probation due to his lack of prior criminal record, others believe jail or prison time is possible, potentially ranging from months to less than four years.

The sentencing hearing is scheduled for July 11, with post-conviction motions to be filed by June 13. Manhattan District Attorney Alvin Bragg has yet to indicate his recommended sentence, leaving the outcome uncertain.

Logistical challenges arise regarding Trump’s Secret Service protection, particularly if he were to be remanded pending sentencing. While past judges have grappled with similar issues, potential solutions include ordering Trump to stay in designated locations, such as a hotel wing or military base, to accommodate security concerns.

Ultimately, the decision on Trump’s fate rests with Judge Juan Merchan, who has previously warned of potential incarceration if Trump continues to violate court orders, despite acknowledging the complexities surrounding his Secret Service protection.
